# Terms of service

> The rules for using the hosted slivingdoc.dev service, what you may store, how billing and limits work, and what we do and do not promise.

These terms cover the hosted service at slivingdoc.dev and api.slivingdoc.dev
(the "service"). The open-source CLI and MCP server are separate: they are
licensed under the MIT license in
[the repository](https://github.com/baalimago/slivingdoc), and running them
against your own bucket involves no agreement with us. How we handle personal
data is described in the [privacy policy](/privacy/).

By creating an account or using a token to reach the service, you agree to
these terms.

## Who we are

The service is run by [OPERATOR NAME], [OPERATOR ADDRESS AND BUSINESS ID]
("we", "us"). You can reach us at [LEGAL CONTACT EMAIL].

## Your account

- You sign in with GitHub or Google. You must be at least 16 years old and
  able to enter a binding agreement. If you use the service for an
  organization, you confirm that you may bind it.
- Keep your API tokens and CLI login secret. Actions taken with your tokens
  are treated as yours. Revoke a token on your account page if it leaks.
- Do not create extra accounts to get around limits.

## Your content

- The service stores UTF-8 text notes that you and your tools commit. You
  keep all rights in them. You give us only the permission we need to store,
  copy, transmit and delete them so the service works, including keeping the
  version history the service records and any backup copies we make.
- You are responsible for what you and the people and agents you share a
  space with put in it. Do not store content that is illegal, that infringes
  someone else's rights, or that you have no right to store.
- Do not store secrets you cannot afford to lose control of. Notes are not
  end-to-end encrypted: they are readable by the service's systems while they
  are stored and processed.
- We do not read your notes as part of running the service, and our admin and
  support tools have no view that opens a note. We can technically access
  stored data, and we may do so if the law requires it or if it is needed to
  investigate abuse, a security incident or a request you have made to us.
- Other members of a space you share can read, and if you gave them write
  access, change its notes. Removing a member stops their access, not what
  they already copied.

## Acceptable use

Do not use the service to:

- break the law or others' rights;
- attack, probe or overload the service, or try to reach another user's
  space or data;
- distribute malware or abuse the service to attack others;
- store binary files or use the storage as a general file host, or resell
  access to the service without our agreement;
- evade limits, suspension or billing.

## Plans, limits and billing

- The free tier and the paid steps, with their prices and limits, are on the
  [pricing page](/pricing/). Limits are fixed caps that you choose. We do not
  charge for going over them; at a limit, writes are refused and reads may be
  slowed as the pricing page describes.
- Payments are handled by Stripe. The seller of record, tax handling and
  invoices are shown at checkout and follow Stripe's terms.
- Plans renew monthly. Changes to your steps take effect at once and are
  prorated. Cancelling stops renewal at the end of the paid period; the
  service then falls back to the free tier, and if your data exceeds its
  limits you cannot write to it until you delete notes or buy steps again.
- Fees are not refunded for periods already started, except where the law
  requires it or where we decide to, for example when a fault on our side
  caused the charge. Nothing in these terms limits consumer rights that cannot
  be waived where you live.
- We may change prices for future periods. We will tell you before a change
  takes effect and you may cancel before it does.

## Availability and your own copy

- We work to keep the service running and your data safe, but we do not
  promise uninterrupted or error-free service, and we cannot promise that
  every note will always be recoverable.
- You can pull your notes with the CLI whenever your tokens work and the
  service is available, subject to suspension and the limits on the pricing
  page. We recommend keeping that local copy or your own backup of anything
  important.
- We may change, add or remove features. We will give reasonable notice
  before removing something you rely on.

## Suspension and ending the service

- You can delete your account at any time from your account page. Deleting it
  removes your data as the privacy policy describes. It cannot be undone, and
  it cancels any active subscription without a refund for the current period.
- We may suspend or delete an account, immediately when needed to protect the
  service or others, if it breaks these terms, causes abuse or security risk,
  or does not pay. We will explain the reason where we can, and where the
  circumstances allow, give you the chance to pull your notes first.
- We may stop offering the service. If we do, we will give you at least 30
  days' notice and a way to retrieve your notes.

## Support

The support chat on your account page is answered first by an AI assistant
that can read limited facts about your account and the public documentation,
and can cancel a subscription at your request. It is automated: an answer from
it is not legal or professional advice, and it cannot change limits, refund, or
suspend anyone. A person can review any decision. You can ask for a person, which is described on the
support page and may carry a fee unless the problem was on our side.

## No warranty, limited liability

- The service is provided "as is" and "as available". To the extent the law
  allows, we give no warranties of any kind, including fitness for a
  particular purpose, and we are not responsible for loss of data, profits or
  business, or for indirect or consequential damage.
- To the extent the law allows, our total liability to you for anything
  connected with the service is limited to the amount you paid us in the 12
  months before the event, or 50 euros if you paid nothing.
- None of this limits liability that cannot be limited by law, including for
  intent or gross negligence, for death or personal injury, or the mandatory
  rights of consumers.

## Changes to these terms

We may update these terms. For a material change we will notify you by email
or on your account page at least 30 days before it applies. If you keep using
the service afterwards, the new terms apply. You may stop using the service
and delete your account before then.

## Governing law

These terms are governed by the laws of [GOVERNING LAW AND COURT]. If you are
a consumer, you also keep the protection of the mandatory laws of the country
where you live, and you may bring a claim in the courts there.
